SUMMARY: LC 40 1267ER

Relates to contracts and purchases by public schools and bidding for government work projects. 

 

REQUIREMENTS:

1  Amends 20-2-501 

Would require that professional service contracts exceeding $50,000.00 over a 12 month period be awarded by local boards of education through a competitive sealed bidding process.

Local boards of education are granted an exemption if the local board, by majority vote, determines the professional services to be procured are unique and can be obtained only from a single source.

The board vote is subject to judicial review by filing an appeal in the superior court of the county in which the local board is located.

The State Board of Education shall be authorized to establish regulations and procedures to implement these provisions. 

2.  Adds Code Section 36-91-103

Would require that the guaranteed maximum price submitted by a construction manager at risk to a local board of education not be changed after execution of a contract. 

Defines "construction manager at risk"
